Win an Olympus TG-6 Camera - Terms & Conditions 

 

1. This competition is a promotion run by CameraPro Pty Ltd (ABN 87 134 765 521) of 232 Arthur Street, Newstead QLD 4006 (the Promoter).
2. Information about the prize and how to enter forms part of these terms and conditions of the competition (the Terms and Conditions). 
3. This competition is a game of chance. 

 

Promotion Period 

1. The competition commences on 18.12.2020 and closes on 28.02.2021 (the Promotion Period).

• be over 18 years of age; and
• not be registered in the CameraPro Basecamp Silver Membership; 

Employees (and their immediate family members) of the Promoter or any related entity or any consultants, suppliers or retailers associated with the Promoter and this competition are ineligible to enter. Immediate family members mean any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

The Promoter reserves the right in its sole discretion, at any time, to: 

1. verify the validity of entries and entrants (including an entrant’s identity, age and place of residence, and purchase of an Eligible Product); and
2. disqualify any entrant who the Promoter believes has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of this competition. 

Any entries which are illegible, comprehensible, offensive or incomplete may be deemed invalid, by the Promoter, in its sole discretion.

Failure by the Promoter to exercise its rights under clause 8 or 9, at any stage, does not constitute a waiver of those rights. 

 

How to enter

1. To enter, entrants must 
1. complete and submit an entry form (including their name, contact details and any other information requested) to the Promoter during the Promotion Period, in the format requested by the Promoter; and
2. follow CameraPro on Facebook, Instagram, and YouTube. 
3. Visit the CameraPro Sydney store at 507 Crown St, Surry Hills NSW 2010.

 

The Prize and Winner

1. The Promoter will select a single winner with a process of random selection. 
2. The Winner will be selected at 9.00am AEST on 05.03.2021 at 232 Arthur Street, Newstead QLD 4006. The Promoter’s decision is final, there will be no right of review and no correspondence will be entered into in relation to same.
3. The Winner will be notified by telephone, email and/or mail within two (2) business days of the draw, with instructions on how to claim their prize. The name of the Winner will also be published on www.camerapro.com.au/win-an-olympus-tg-6-camera for a period of not less than 28 days from the date the Winner is selected.
4. The Winner will receive 1 x Red Olympus TG-6 Camera. 
5. The Prize is not negotiable, transferable, exchangeable or redeemable for cash or other currency.
6. The Promoter makes no representations or warranties as to the safety, quality, suitability or merchantability of the Prize. The Prize is not for distribution or re-sale.
7. The Promoter will use its best endeavours to provide the Prize as described in these Terms and Conditions. If the Prize (or any element of the Prize) is unavailable, the Promoter, in its absolute discretion, reserves the right to substitute the Prize (or that part of the Prize) with a prize of equivalent value and/or specification, subject to any written directions from a regulatory authority. 
8. Subject to the below clause 24 (Unclaimed Prize), if for any reason the Winner does not take or claim the Prize (or an element of the Prize) by the time stipulated by the Promoter, which time will be 7 days, then the Prize (or that element of the Prize) will be forfeited and will become the property of the Promoter. 

 

Unclaimed Prize

1. A re-draw for the Prize, if unclaimed, may take place on 26.03.2021 at the same time and place as the original draw, subject to any written directions from a regulatory authority. The new Winner, if any, will be notified by telephone, email and/or mail within two (2) business days of the draw, within instructions on how to claim their prize (the new Winner). The name of the new Winner will also be published on www.camerapro.com.au/ win-an-olympus-tg-6-camera for a period of not less than 28 days from the date the new Winner is selected.

 

General

1. Force Majeure If this competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, illegality, direction of any regulatory authority, unauthorised intervention, fraud or act of God, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to the instructions of any regulatory authority, to modify, suspend, terminate, postpone or cancel the competition, as appropriate.

 

1. Release To the extent permitted by law, the entrant agrees to release and forever discharge the Promoter (including its officers, employees and agents) from and against any and all claims, demands, liability, damages or causes of action (however named or described), and any loss or damage, whether direct, indirect, special or consequential, (including but not limited to loss of actual or anticipated profit, loss of goodwill, loss of reputation, loss of opportunity, loss of savings and/or loss of contract) or for personal injury or death caused to any person, arising out of or in any way related to this competition or acceptance or use of the Prize, including, but not limited to, where arising out of the following: 
1. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
2. any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
3. any variation in the value of the Prize to that stated in these Terms and Conditions;
4. any tax liability incurred by a Winner or entrant;
5. participation in this competition;
6. participation in any activities which form part of are related to the Prize, 
7. provision of any services which form part of the Prize, including airfares, accommodation, and transportation; or
8. misuse of the Prize.

For the avoidance of doubt, this clause is not intended to exclude any liability which cannot be excluded under the Australian Consumer Law. Any such liability is, where possible, limited to the resupply of the Prize.

• Indemnity The entrant agrees to indemnify the Promoter (including its officers, employees and agents) from and against any and all claims, demands, liability, damages or causes of action (however named or described), and any loss or damage, whether direct, indirect, special or consequential, (including but not limited to loss of actual or anticipated profit, loss of goodwill, loss of reputation, loss of opportunity, loss of savings and/or loss of contract) or for personal injury or death caused to any person, arising out of or in any way related to this competition or acceptance or use of the Prize. 

1. Personal Information The Promoter may collect personal information of any entrant (“PI”) in order to conduct this competition and may, for this purpose, disclose such PI to third parties, including, but not limited to, agents, contractors, service providers and prize suppliers. By entering this competition entrants consent to the use of their PI for the purposes described in this clause. The Promoter will also use and handle PI as set out in its privacy policy, which can be viewed at www.camerapro.com.au . In addition to any use that may be outlined in the Promoter’s privacy policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or making phone calls to the entrant. The Promoter’s privacy policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. Unless otherwise indicated by the Promoter, the Promoter may disclose PI to entities outside of Australia.
2. Laws The competition and these Terms and Conditions shall be governed by the laws of the State of Queensland to the exclusion of any other law. Entrants shall submit any lawsuits to the exclusive jurisdiction of the courts of that State.
